Minimum Advertised Price Policy (MAPP)
Effective Date: June 1, 2026
This Minimum Advertised Price Policy (“MAPP Policy”) establishes the minimum advertised pricing standards and resale channel requirements applicable to retailers who advertise or sell Hyer Boots products (“Products”).
Hyer Boots maintains this Policy to preserve a consistent premium brand presentation and to ensure a fair and competitive marketplace for authorized retailers.
This MAPP Policy is unilateral and non-negotiable. Hyer Boots reserves the right, in its sole discretion, to determine whether to continue supplying Products to any retailer that does not comply with this Policy.
1. Definitions
1.1 Products
“Products” means all Hyer Boots branded footwear, accessories, and any other merchandise manufactured, distributed, or sold by Hyer Boots and supplied to a retailer for resale.
1.2 MAPP (Minimum Advertised Price)
“MAPP” means the minimum price at which a Product may be advertised by a retailer.
Unless otherwise communicated by Hyer Boots in writing, MAPP for all Products is equal to the Manufacturer’s Suggested Retail Price (“MSRP”).
1.3 Advertising
“Advertise, Advertisement, or Advertising” means any promotional communication used to promote the sale of Products to consumers, including but not limited to communications appearing in:
- websites and mobile sites
- email marketing or newsletters
- SMS or text messaging
- social media posts or advertising
- search engine or digital advertising
- banner or display advertising
- printed materials, catalogs, or mailers
- broadcast or streaming media
- outdoor advertising
Any public display or communication of Product pricing constitutes Advertising under this Policy.
1.4 Advertised Price
“Advertised Price” means the price stated or displayed in Advertising for a Product, including any price shown after applying coupons, promotional codes, rebates, store credits, or similar incentives.
2. MAPP Price Standard
2.1 MAPP Equals MSRP
Retailers may not Advertise Products below the MSRP established by Hyer Boots unless Hyer Boots provides written notice establishing a different MAPP.
2.2 Advertising Below MAPP
Retailers may not Advertise Products below MAPP in any medium or channel.
2.3 Price Concealment
Retailers may not use mechanisms designed to conceal or delay the display of a below-MAPP price, including but not limited to:
- “add to cart to see price”
- “call for price”
- “DM for price”
- similar tactics intended to obscure advertised pricing
2.4 Promotional Discounts
Retailers may not Advertise promotions or incentives that reduce the effective advertised price below MAPP, including:
- percentage-off promotions
- promotional or coupon codes
- loyalty pricing
- rebate programs
- “instant savings” offers.
2.5 Bundled Offers
Retailers may bundle Products with other items provided that:
- the Product remains advertised at or above MAPP; and
- any discount applies only to non-Hyer items.
2.6 Closeout Products
Hyer Boots may designate certain Products as “Closeout Products.” Closeout Products are exempt from this Policy’s minimum advertised price requirements and may be advertised and sold at any price. All other terms of this Policy remain in effect unless Hyer Boots states otherwise in writing.
3. In-Store Pricing Independence
This MAPP Policy governs advertised pricing only.
Nothing in this Policy restricts the price at which a retailer may sell Products inside its physical retail location. Retailers remain free to determine their own final selling prices within their stores.
4. Online Sales Requirements
Retailers may advertise or sell Products online only in accordance with this Section.
4.1 Authorized Online Channels
Retailers may sell Products online only through:
- their own branded website(s); or
- retailer-owned social commerce storefronts.
These are collectively referred to as Authorized Online Channels. Retailers must maintain operational control of these channels and ensure all Advertising complies with this Policy.
4.2 Marketplace Prohibition
Retailers may not advertise or sell Products through third-party online marketplaces where multiple sellers offer goods through a centralized platform operator.
This restriction includes, but is not limited to:
- Amazon
- eBay
- Walmart Marketplace
- Target PlusStockX
- GOAT
- Grailed
- Facebook Marketplace
- Poshmark
- Mercari
- or any similar marketplace or resale platform
4.3 Unauthorized Online Channels
Any online sales channel that is not an Authorized Online Channel is considered an Unauthorized Online Channel. Hyer Boots reserves the right to determine whether a platform constitutes an unauthorized channel.
4.4 Indirect Marketplace Sales
Retailers may not sell Products to any person or entity that the retailer knows or reasonably should know intends to resell Products through prohibited marketplaces or other unauthorized online channels.
4.5 Brick-and-Mortar Requirement
Retailers selling Products online must operate at least one legitimate brick-and-mortar retail location that:
- is open to the public
- has a verifiable physical address
- receives regular consumer foot traffic
- sells western footwear or related products consistent with Hyer Boots’ brand positioning.
4.6 Retailer Transparency
Retailer websites must clearly display:
- business name
- physical store address
- customer service contact information
- return policies
Retailers must not imply that their website is owned or operated by Hyer Boots.
4.7 Sales Reporting
Retailers that sell Products online must provide Hyer Boots, upon request and no more than once per calendar quarter, a summary report showing total sales of Products, including:
- in-store sales
- online sales
Failure to provide requested reporting may result in suspension of online sales authorization.
4.8 Domain Names and Website Identity
Retailers may not register or operate domain names containing “Hyer,” “Hyer Boots,” or confusingly similar variations of Hyer Boots trademarks.
Examples include:
- hyerboots-sale.com
- buyhyerboots.com
- hyerbootstore.com
Retailers may sell Products only through domain names clearly associated with the retailer’s own business identity. Retailers must not operate websites that create the impression of being an official Hyer Boots website.
5. Paid Search and Keyword Advertising
Retailers may not bid on Hyer-branded keywords in paid search campaigns.
Restricted terms include:
- “Hyer”
- “Hyer Boots”
- Hyer product names
- Hyer product line names
- close variants or misspellings
This restriction applies to keyword-based paid search advertising.
Retailers may participate in:
- Shopping ads
- Performance Max campaigns
provided all other provisions of this Policy are followed.
6. Affiliate Marketing and Coupon Sites
Retailers may not advertise or promote Products through:
- affiliate marketing networks
- coupon or promotional code websites
- cashback or rebate platforms
- deal or flash-sale sites
Retailers must take reasonable steps to prevent Products from appearing on such platforms.
7. Enforcement
Hyer Boots may monitor retailer Advertising and pricing practices.
If Hyer Boots determines that a retailer has violated this Policy, Hyer Boots may take enforcement actions including:
- issuing violation notices
- requiring correction of Advertising
- canceling orders
- suspending product supply
- restricting access to Products
- terminating the retailer relationship
Hyer Boots may take such actions immediately.
8. Policy Updates
Hyer Boots may modify this Policy at any time. Retailers are responsible for complying with the most current version.
